The state of Illinois refers to rape as criminal sexual assault. This sex crime is defined in 720 ILCS 5/11-1.20 as using force or threat of force to commit an act of sexual penetration; committing sexual penetration with a person who is unable to understand the act or give legal consent; or committing sexual penetration with a family member under 18. It is also committed when a person who is 17 or older commits sexual penetration with a child between 13 and 17 years old who is under their direct care.
As a Class 1 felony, criminal sexual assault is punishable by 4 – 15 years in jail or prison and a fine of up to $25,000. Keep in mind, however, that there are aggravating circumstances – such as a prior conviction or the display of a deadly weapon – that could increase the penalties even further. Aggravated criminal sexual assault is a Class X felony punishable by 30 – 60 years in prison.
